If they re-file, they prove that they are acting in bad faith, and they give CTIX even more grounds for bigger damages. I don't think even Rosen would try to do this.

However, they might try to negotiate with CTIX for us to drop any action against them if they agree not to re-file. If they try that, it would be a mistake for Leo to accept a deal like that.
