Investing and or taking profits is not illegal.
Making loans at rates higher than those allowed by law is illegal.
Shorting a stock is not illegal. However if a lender shorts a stock and in doing so ends up getting more shares and more profit than they would have gotten. It's a form of market manipulation which is against SEC rules.
