They have been trying to drag it out as long as possible, in the hope that they could run up CTIX's legal bills to the point where CTIX would agree to go away in return for them dropping the suit, or that some miracle would happen. They failed to take into account that they are SO wrong about this that the Ashcroft firm would take CTIX options in return for legal fees, so they are not able to run our bills up in a way that will hurt the company.

If I were Kim, Stern, etc. I'd wake up screaming in the middle of the night. But, they are so used to being able to greenmail innocent companies into settling with them, and always getting away with it, that they are continuing to attack other companies instead. It would be fantastic if this judge were brave enough to sanction these guys and put them out of business, but I'm not holding my breath on that score. I'd sure love it if we could get Rosen to pay our legal fees though.

And then if CTIX can get the SEC to look into them.... and Mako.... and our other little friends involved in this scheme.
