i've always thought it was naked shorts playing games. i talked to scottrade about it and their policy is they do not allow borrowing of shares and that the SEC has cracked down on it. i assume some brokerages have loose policies where that is allowed. i dont believe the SEC can or does or is even able to enforce penalties against naked shorting.
