I hope you are entirely right, but I would be surprised if Ashcroft can't get paid in the event share price does not reach 1.70 (help us all!). If those are actually the full terms of the contract, then the agreement really is contingent in a sense, though not in the sense that Ashcroft must win to receive a fee.
