If HJOE files now, KBM will not convert as it would more than likely prove HJOEs case.
If HJOE files now it opens the door for KBM to simply drop the suit, convert and put HJOE into the death spiral. Its a standoff.
Filing shouldn't take place until the judge makes a ruling or mediation takes place and there is a cash settlement. That's just how I see it.
