i dont know how they WOULDNT be. it goes to the heard of the claim of usury/predatory lending let alone "damages" that KBM can claim on the original suit. besides good faith, viable contracts, manipulation, securities fraud, etc - how were they actually damaged by HJOE's alleged breach?
in order to prove they were damaged - they should be forced to show what the proceeds were from the loan(s). my guess is they will try to separate the conversions from the actual loan payback/interest as a "penalty" or some other thinly veiled financial maneuver.
