Agreed - though I would assume that the majority if not all of the internal discussions would have been with legal counsel, or at least counsel would have been cc'ed into the conversation. Decisions on the scale of millions of dollars in dividends being held or released are not made flippantly. That being said, it is very odd to me that said Etrade counsel to this point has yet to weigh in on any of the legal documents that have come their way - very rare if not unprecedented for such a large financial firm. Etrade has a formidable legal team that is accustomed to ongoing legal issues as just the cost of doing business. It has done itself no favors to this point to just stick its head in the sand.
