Etrade completely ignored two letters and a subpoena from COR in the Nebraska case. Today Etrade's response is due in COR's New Jersey subpoena. I am highly curious to see if and how they respond. The judge is scheduled to rule Monday Feb 1st on COR's motion to compel, and he probably won't be too pleased with Etrade if they choose to yet again ignore a subpoena.
I think COR makes a good case to see Etrade's shareholder counts. Requesting their internal decision making processes regarding the dividend is a bit more of a stretch, but if the judge grants that as well look out.
