I have no doubts that this counterclaim will be exactly as you state. I believe the issues of the note will be addressed much sooner then anyone expects, and I say this because KBM is stating in one of the causes of action that they want these shares immediately because hjoe is insolvent. ( not in those exact words) hjoe will respond to this and most likely request a pre trial hearing, or possibly just file s response with evidence and the proper affidavits showing that hjoe is not insolvent. Either way this issue that they raise will allow hjoe to file much sooner then anyone expects. The judge will order conversions, order a stay for this matter to be heard at trial, or tell KBM to f?,? Off, regardless this issue of notes is coming to an end. I would doubt that the judge would order these notes to be converted when the company is offering cold hard cash. These guys and their bashers have a big shocker coming their way.
