Remember judge can THROW OUT the case right now. Judge can sanction Rosen RIGHT NOW.
They are demanding a jury trial because they know the judge has their number and can't be fooled. Jury trial also runs up the costs for CTIX.
Their strategy is to try to make it painful for CTIX to stay in the game, so that Rosen can try to negotiate a deal with CTIX for all sides to drop all claims. I hope that everyone tells Leo they support him taking them to the cleaners, no matter what we have to pay the Ashcroft firm. We will get the legal fees back when we win (and also I sure hope they file suit against all parties).
Personally, I think that the magnitude of the misstatements made by Mako and repeated by Rosen would be easily understood by a jury. All you have to do is point out that the supposedly empty offices are not empty and that the photo supposedly proving Mako's claim was taken in the DEAD OF NIGHT as evidenced by the blackness of the exterior windows -- and the article claims that it was taken during "working hours" in August. Since when does the sun set before 5 p.m. in August? That right there proves their malign intentions, and no amount of obfuscation can cover that up.
