ALL of their claims about Menon were from long before the period in question. It's a frivolous claim anyway -- does anyone really believe that people make an investment decision on where a scientist got a Ph.D., rather than the first clinical trial (and animal trial) data? Is the institution granting a degree more important the FDA granting QIDP status?
Rosen firm really doesn't have a leg to stand on. And I am cheered by the poor nature of Stern's letter to the judge asking for another 5 days. First he repeats the devastating arguments by CTIX why they SHOULDN'T grant an extension, and then says, "but I'm busy so I need more time."
However I do expect the judge to grant it. She's made it clear that SHE doesn't want to be rebuked like her colleague, and it might be viewed as unreasonable not to grant 3 business days and a weekend. Remember that lawyers always give professional courtesy to each other and judges are lawyers, after all.
