The average NAFTA Judgment for a simple Contract Claim / Tortious Interference Claim such as ours is about 5 years,
Nothing complicated here such as OIL, AIR, MINERAL and WATER rights which seem to make up most NAFTA claims.
Mediation to settle for less can happen at any GIVEN MOMENT.
I would expect as we get closer to both a OMB and Federal Judgment that mediation will be at its HIGHEST POINT of INTEREST.
Remember NAFTA is a international Court and has nothing to do with OMB or The Federal Court of Canada. Regardless whether we do or don't find our remedy for both Zoning and a License,
NAFTA will remain in PLAY for monetary DAMAGES, unless mediation fosters a 5 Billion dollar dismissal.
A WIN is A WIN and we WON BIG.
