I would try to get a letter from E trade stating that although the dividend will show on the 1099 that the dividend has not been distributed due to their hold. I would then file that with your taxes. All the IRS will know is that they got a 1099 from Etrade that you received the dividend and they will hold you responsible for that dividend (for taxes).
