FINRA didn't make a mistake. The rule was clear.
CRGP is the one who likely messed up understanding the rule when they declared the dividend at a time the share price supported it. They paid the dividend, which I credit to CRGP for not bailing out.
Just because something strange happened doesn't mean another even stranger event, one that flies in the face of clear due process, will necessarily occur. Provide evidence that what you're saying is true, not false equivocation and stretched logic.
