If a shareholder held until the ex dividend date and actually receives a dividend that "settles" into his/her brokerage account then he is the owner of that cash.. If there is a later dispute as to "ownership" of the cash, the entity seeking to "clawback" has the burden of proving that the specific shares owned by the shareholder were not entitled to receive a dividend. The administrative costs associated with this would be enormous to the point where it would not even be worth going after each individual shareholder. Instead, the entity would go after the "negligent party" for the cash. (I.e. CRGP) Upon conducting extensive research, I can't find any cases on point, where a shareholder of a publicly traded United Stated company had a dividend taken back after receipt.
