There is solid information that contradicts your theory.
There is NO MENTION of failure anywhere in the communications.
In fact on our side we have seen a bit of shock from all entities involved. If this guy is an employee he went rogue and is in deep trouble. He is not operating within the framework of the FAA. Liabilities abound.
The alphabet agencies involved would not be involved if this was OK.
Does this make sense?.
