I have to laugh I give Janice shel two examples of shorting fraud as asked and get this response:

As I recall, it was one that had no bearing on penny stocks. Wasn't it about Overstock? As to the Merrill action, it had nothing to do with penny stocks either.
So here we are with shorting fraud on regulated markets, and I'm chided because they do not cover the Wild West unregulated OTC
Janice is just a calmer smarter version I surmise
