Ummm...actually it's the bashing part that is illegal.
There is nothing wrong with paying somebody to say something positive or negative about anything (see your own First Amendment comment).
The problem is in the deformation, lies, and deception. The "manipulation" is the crime. It doesn't matter if they are an individual or somebody paying another individual to do it. That only points to who is complicit.
On that note: If you look at my posts, I don't insist that they are paid (or not). I don't even care. My point is that they cannot be ignored and allowed to take over the message boards and fill them with lies. Like it or not the DO have an impact...especially in speculative OTC stocks.
