“Given that the matter is now before the courts, Health Canada cannot offer any further comment,” -- I say we are talking to HC now and this will be resolved. IMO HC will make a statement to the effect that they have reviewed alleged allegations and/or re-inspected the facility and are satisfied with their findings...fingers crossed.
