You seem to suggest that the letter doesn't exist. I think we can get past the question of it's existance now considering there has been a response by the company, and the following quote in the response.

"In this case however, key information contained in Health Canada's written communication was passed to the media."

Which I can only assume is reference to the "intent to reject" quote.

I agree that this is merely a request for more information, and the declination of the requested info would result in denial.
