Since you're a lawyer (I'm assuming), when did the property use become growing MMJ?
I would think it was when the property was inspected by Health Canada, and that fits your theory. The town's position is clearly that they have the correct zoning at the moment, but once they actually use the land to grow MMJ, they need the zoning change.
Its interesting because its a new industry, and I have no clue how to feel there.
