Yeah, it makes no sense to require the setback AFTER the fact at site 1. I'd expect a deal to change to industrial zoning and then good to go.
Thats a win-win at this stage, and CEN could fight the zoning change after receiving the license. The license is the big thing here. Just take the lumps until its achieved.
And frankly, the tax difference will NOT break CEN. Not getting the approval will.
