It would appear grandfathering is not a consideration since the lawyer was asking for that section to be removed, and he is correct in asking for that to be removed because it goes against CEN and seems also to indicate the license has yet to be granted otherwise it would not be an issue.

Both sides gave me the distinct impression this is going to land in court.
