It would be a good lawsuit for sure. Both sides make a good case. The company would argue that since their intentions were known at the time of zoning approval that they should be grandfathered. After all, you can't blame the company for not already growing. There are licensing requirements to be met, else this is a no brainer.

It would be interesting, but I don't think its a factor at all.
