Took another read through the initial rejection and it is pretty clear.

Two objections

1 - same objection over obviousness as  the first patent and the need to demonstrate unique characteristics in the claimed range. This the claims were amended to reflect the range same as the first patent

2 - Double patenting which requires the submission of a form accepting the double patenting and the date of the approved patent. Basically it is rejected over obviousness in light of Elite's allowed patent claims. thus the double patenting
