A prior well owner drilled there in 2007, but only had the rights below 5000ft.  They wire-lined the entire well and we now have those logs in our possession and will drill where the existing pad is

The prior owner only had rights to below 5000 ft. Assuming they must have found no oil there, could they have not gotten a permit to change to depth to above 5000 ft? if they identified some interest in the hole ? Treaty must noticed something our benefit in the wire log.
