I would have to think that if that site ever ends up in litigation all those removed posts are going to be discoverable evidence that will come back to haunt them. Also - all of the emails to customer service complaining about the moderators will show that the site was put on notice of everything that was going on. I made sure to send my notice email a few weeks back.
