If the critical point for you is whether Mr. Bordynuik has anything novel, you could ask the company directly. So far all we know is that the patent office wouldn't issue any patent for Mr. Bordynuik's 'design' because they felt there was nothing unique about it. Of course the US Patent Office is made up of people and people sometimes make mistakes. Maybe JBI can tell you specifically what's unique about their process and why they feel the Patent Office is wrong.
