The standard high win percentage response from a litigator is 70-80% since one can't account for how a particular judge will respond on a particular day. Having seen how this plays out in real cases, I assign BCAP an even higher win rate.
Very simply Mr. Stanz needs to prove he's settled all the terms of the Asset Purchase Agreement. If he can't do that he's finished no matter what alternative legal strategies are attempted.
Couple of points to demonstrate how bogus the "FINRA investigation" line is:
Are FINRA going to fine BCAP for extending loans at 18% apr when credit cards do it at 29.99% apr? Really....
Maybe FINRA will shut down all convertible debt lenders, BCAP included... LMAO
