RIGH doesn't have a legal case, but they do have a legal team.
I've seen this game played out many times, and what Mr. Stanz is doing is very typical for defaulted debtors.
I'll even tell you RIGH's pre-trial legal costs are going to be 250-300% BCAP's, but without proof of settlement they can spend $50M on legal opinions and it won't change the outcome.
When it comes to pre-trial the judge(s) will review the paperwork to see who breached their side of the contract. Mr. Stanz can't prove settlement of the 800k RIGH Preferred, so its already game over. There's no leverage remaining other than emotive arguments.
RIGH is a standard default, and it'll be a standard lesson in why its better to invest in the creditor than the debtor.
As for belief: I simply follow the primary and secondary documentary evidence filed by both sides. The rest is noise.
