Ok let me get this straight he's is filing suit against a pinky stock he invested when everything looked bright. Now that it doesn't look so good he wants his money back.

Last time I checked investing in any stock is a gamble. You want a guarantee , put it in a savings account and draw your 3 % if your lucky.
