I think the media credits should have been a warning shot to every long out there. If the founder who controls every aspect of how investors' money is spent, went to those lengths to deceive investors, you have to at least consider that you're not dealing with an honest guy.

If you think the SEC just made stuff up, I suppose that's one angle. But if you think there's truth then you should consider if he has your interests in mind or if he's being dishonest because he's squared off against shareholders.

Yes, I understand your penny stock also is the real deal, created with the inventiveness of Edison and destined to be the next Microsoft. Yes, I understand that the delays are also only because your company is making their product and/or technology even more revolutionary.
