RIGH owes BCAP 8B Common + penalties and interest. That's roughly 15B Common by my calculation. Either they pay, or they to through Chapter 11 + a R/S.
Personally I'd bankrupt RIGH. There's more value to BCAP from Chapter 11 then from debt repayment.
