I'm not a lawyer,, but I am a retired broker--
Amy got "busted" and lost a significant portion of her profit ---
TRTC just made a couple bucks from both Amy's good fortune and her msifortune
"INTENT" is not an issue in this type of situaton,, as Amy had no crystal ball that said TRTC stock was going into the toilet for a short period and that she would have an opportunity to reacquire a nice position.
