Just because the merger agreement reflects the SKTO/AEGY position on their IP, doesn't necessarily make it legally accurate or true. I'm not saying that it's not true, just that them writing it down doesn't make it true.
I'd feel better if we heard from AV a long time ago that they are walking from the BBio claim. If the AV attorneys wanted to get in the way of this, they probably could. Lawyers can be bastards, right LG?
I read it as they are currently free of claims against their ip. What does that mean exactly? No one has sued them?
