stocker:  What I would recommend is banning naked shorting and make it a criminal offense.

Many companies are on the verge of causing naked shorts to lose their shirts by paying cash dividends.  That trend is growing and the more unprofitable naked shorting becomes the less there will be of it.  The Overstock case when it finally goes before a jury could speed up the process as many of the "too big to fail" are involved.  Interesting days ahead to be sure.
