If you read that filing profusely, you will notice that there is an out for said note holder.  The .025 conversion fix does have an adjustment clause to protect the investment.  With that being said.......you have six months before the first $190k is convertible.  If that share price is not above that fixed conversion price.....you know who to blame....and it's not going to be the company(at least highly doubt it)....it's the same scary mentality that I have preached about for years..........."drum roll"......................RETAIL.
