This is only something Matt can deal with. We can help, but we need material information (brokerage, clients, TA, financials, etc.) If those news items don't help, then the only remaining course is litigation.
The legal action is a civil case, not a criminal case. It has no hearing on BCAP or Matt Dwyer's fitness to be a company officer. If I'm not mistaken this was raised and answered around February 2012.
I didn't read the filing in detail. If anyone did and they want to address the content here, it would be appreciated.
For What it's worth: There will always be bashers at every price point. BCAP could trade at $10/share on NASDAQ and you'd see the same issues regurgitated over and over again. The difference down at this level is frequency of posts.
I'll place a friendly bet that when the audited financials are complete we'll see a new line that the auditors are frauds (along the STAI line of bashing).
