There are two issues. Manipulating prices of stocks or conspiracy to manipulate prices of stocks that trade on a national exchange and/or through the use of interstate wires are flat-out federal offenses. That is separate from those seeking damages caused by stock manipulators; the damaged party much prove material losses in civil court.
