I can say this with some level of confidence; the silence is ongoing for multiple reasons and not all court related.  When TECO attacks back it will be in successive bursts using a nuclear arsenal!
I truly believe they understand the wrath they will face and years of litigation if not successful.  There are too many aggressive and smart heavy hitters who own this stock for TECO not to be successful.
