This venture aims to generate profit that will be donated to veterans' charities, the Pennsylvania Freemasons, and the three charitable societies founded at The Tun. The Legacy Foundation has secured federal trademark rights to the name "The Tun," purchased a piece of land on South 2nd Street, and commenced fundraising for the construction. Architectural plans have been approved, and building permits are in place. So far, the Foundation has raised approximately $11 million out of a projected construction budget of $21 million.

In May 2024, Aljess filed a lawsuit against the Legacy Foundation in federal court, asserting that the Foundation's attempt to open its version of The Tun would infringe on its trademark rights and create confusion for patrons. Later, in November 2025, Aljess opened a new Tun Tavern restaurant on Chestnut Street in Old City as part of their expansion.

The recent settlement marks a resolution to the conflict over their competing visions for The Tun in Philadelphia. While the specifics of the settlement remain confidential, it is public knowledge that the lawsuit has been dismissed, and the Legacy Foundation is permitted to use the "Tun Tavern" name within its historic reproduction. Conversely, Aljess will maintain its rights to open Tun Tavern locations elsewhere in the country.

For nearly three decades, I have been proud to uphold this historic legacy. I always envisioned a project of this magnitude moving forward in Philadelphia, the cradle of our nation's independence, and I am confident that The Tun Legacy Foundation will achieve this goal. I feel we have reached a harmonious agreement that honors the birthplace of the Marine Corps and those who have defended our country while preserving the deep historical significance of The Tun. This resolution allows Aljess to pursue its future growth while ensuring the story of the Tun Tavern is told with the reverence it deserves."
